TERMS & CONDITIONS

These Conditions apply to all persons entering and making use of the Green Man Festival Site (“the Site”).

Entry and Access:

1. Entry to the Site will only be authorised upon presentation of a valid ticket, authorised voucher, pass, wrist band or accreditation issued by or on behalf of Green Man and, if required by Green Man, photographic proof of identity from an accredited source such as a UK Driving Licence or passport.

2. Ticket holders enter the Site at their own risk.

3. Under 18s including Teenage Ticket holders and Students must bring proof of age as due to licence conditions they may be required to provide proof of age and/or a Student iD card (issued by NUS or ISIC only) or confirmation from their educational establishment prior to entry or anytime while on site.

4. Children aged 4 and under require an Infant ticket to attend the Festival, Children aged 5-12 require a Little Folk Ticket. Up to 4 children will be permitted entry with one adult (aged over 21) ticket holder.

5. Under 18s must be supervised by a responsible adult (aged over 21) at all times. Parents and guardians assume responsibility at all times for minors on the Site who are attending with them.

6. Access to certain areas of the Site are restricted to authorised persons only and/or may be subject to certain conditions. Non authorised persons must not enter into or make use of restricted areas unless specifically authorised so to do.

7. Pedestrians will only be admitted to Site via the Tower Bridge reached by the footpath along the River Usk.

8. All live in vehicles/trailer tents/caravans/tipis can only camp in the live in vehicle area reached via the Live In Gate on the A40 and having entered the site cannot leave until the 18th of August 2024 and there will be no re-entry to the site after the live in vehicle has left. .

9. Live in vehicle tickets must be bought in advance and cannot be obtained at the box office. Only live-in vehicles and caravans are allowed in the designated campsite. No cars are allowed in the campsites.

10. All live in vehicles under 6m in length require a Campervan Pass (maximum pitch size is 6m x 5m), all live in vehicles over 6m or that are towed by another vehicle require a Motorhome Pass, maximum permitted length of Motorhomes or caravan and car together is 9m (maximum pitch size is 9m x 5m).

11. All Attendees must fully comply with the direction of authorised stewards.

12. The right to refuse admission are reserved to Green Man in the event that it considers entry will constitute a risk, inconvenience or disturbance to others. Any person who is reasonably suspected by Green man and its authorised agents of having committed, or being likely to commit, a criminal offence within the Site may be ejected from the Site at any time.

13. Attendees are permitted to bring alcohol for personal consumption which is not contained in glass into the camp-sites but not into the Event Area dictated by the festival licence.

14. It is illegal to sell alcohol to or purchase alcohol for those aged under 18. For licensing reasons Attendees aged 17 and under must stay at least 2m away from any bar or place dispensing or selling alcohol. If Attendees appear to be under 21 they will be asked for identification.

15. Green Man reserves the right to limit items which may be brought to the Site and to search bags, vehicles and persons before granting entry to the Site or certain areas of the Site. Attendees agree to such searches and Green Man reserves the right to refuse entry to, or to eject from the Site, anyone refusing to submit to such a search.

Prohibited Items:

16. Attendees in possession of Prohibited Items may be refused entry or ejected from the Site. Any Prohibited Items which are surrendered as a condition of entry to the Site shall be deemed to be surrendered irrevocably and voluntarily. Any such items will be unable to be reclaimed and shall be disposed of by Green Man without any liability.

17. The following items are specifically prohibited from being brought onto the Site or made use of on the Site:

(a) Illegal substances;

(b) Open fires, or tin foil barbeque or equivalent devices which could potentially damage grassed areas;

(c) Generators or any other petrol fueled apparatus;

(d) Pets and animals (other than pre-authorised guide dogs);

(e) Glass bottles or containers or glassware of any kind;

(f) Any item which may be interpreted as a potential weapon and/or compromise public safety, including sharp or pointed objects (e.g. knives, large corkscrews), ‘personal protection’ sprays;

(g) Fireworks/flares/explosives/Chinese lanterns or other pyrotechnic devices;

(h) Sound systems;

(i) Laughing gas;

(j) Lasers and strobe lighting;

(k) Psychoactive substance within the meaning of the Psychoactive Substances Act 2016;

(l) Gas cylinders in excess of 5Kg;

18. Visitors in possession of Prohibited Items may be refused entry or ejected from the Site.

Safety and Security

19. Attendees must comply with the instructions of Green Man and or its authorised agents (including stewards and security staff) and/or any police officer. Any failure to comply with such instructions may lead to ejection from, or refusal of entry to, the Site.

20. Music and amplified sound may be in excess of 100 decibels and prolonged exposure can damage hearing especially to young children and ear protection is recommended.

21. The River Usk represents a specific danger and does not form part of the Site. The river is subject to rapid changes in condition. Swimming in or accessing the vicinity of the river outside the Site is specifically prohibited and will constitute a trespass. Any person swimming in or making use of the River Usk adjacent to the Site will be ejected from Site.

22. Attendees must refrain from walking along the B4558 or grass verge to Crickhowell which is considered dangerous. Pedestrian routes to Crickhowell are available from stewards and maps near the pedestrian exits.

23. Hired temporary accommodation must be obtained from Green Man's specified contractors only, which are separate organisations from the Green Man Festival. Hired temporary accommodation from other supplies may be prohibited from the Site. Green Man who are therefore not responsible for any problems arising.

24. The positioning of vehicles and camping equipment has been agreed by the Licence Authority and is subject to the direction of Green Man stewards and in exceptional circumstances may be required to be repositioned within the Site. Vehicles, tents or any other obstructions will be removed from fire lanes. Attendees with authorised Live-in vehicles will be entitled to erect only a single awning or canopy adjacent to the Live-in vehicle.

25. Trespassing on adjoining private property to the Site will result in expulsion from the Festival.

26. Medical matters are dealt with by Medic 1 Direct Ltd. This is a separate organisation from the Green Man Festival who is not therefore responsible for any problems arising.

27. Thieves may operate within the Site. Attendees should not leave money or valuables unattended in any area of the Site.

28. Climbing scaffolding or any permanent or temporary structures, flag poles or trees is strictly prohibited.

29. Any form of trading on or in connection with the Site or Green Man Festival or supply to Attendees of Green Man Festival is prohibited and may result with expulsion from the site.

Consideration for Others

30. Please have consideration for other Attendees.

31. Attendees must not use any electronic equipment or amplified sound or musical instruments in a manner that may inconvenience or cause nuisance to others.

32. Green Man reserves the right to remove and/or deny access to the Site to an Attendee who:

(a) has behaved in a manner which, in the reasonable opinion of Green Man has, or is likely to affect the enjoyment of other Attendees; by

(b) using threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or

(c) in the reasonable opinion of Green Man is under the influence of drugs or has consumed an excessive amount of alcohol; or

(d) fails, when required, to produce proof of identity or age; or

(e) obstructs fire lanes, access-ways, exits, entrances or congregates in non-designated areas or seeks entry to areas for which she/he does not hold a wrist band; or

(f) may endanger the children or teenagers in their care; or

(g) uses large structures exceeding in purpose the number of those who have purchased tickets and refuses to remove them; or

(h) uses gazebos, event shelters, wind-breakers, temporary toilet or kitchen structures into the camping area which may obstruct the ability of other attendees to camp and refuses to remove them; or

(i) uses materials to rope off areas from the rest of the site and refuses to remove them; or

(j) uses a temporary structure, chair or trolley which obstructs viewing opportunities for other attendees in the entertainment areas, or could obstruct safe crowd movement and refuses to remove them; or

(k) brings glass onto site; or

(l) brings personal alcohol into areas outside of the camping and live-in vehicle areas; or

(m) uses the B4118 or A40 to or from Crickhowell to the site as a pedestrian where there is no pavement which could endanger themselves;or

(n) damages or generates disturbance to the natural ecosystem of the site: or

(o) doesn’t observe our leave no trace compliance in relation to rubbish.

Photography, Filming and Recording

33. During the Green Man Festival various filming, photography and broadcasting takes place on the Site. By attending the Festival, Attendees grant their permission, free of charge, for their image, likeness and voice to be included in pictures and/or on film and/or audio broadcasts or transmissions and their exploitation and advertising without compensation or credit. Attendees acknowledge that any such use under this condition, and their agreement to such use, shall last in perpetuity.

34. Attendees on the Site acknowledge and agree that Green Man is the sole legal and beneficial owner of any intellectual property rights (including copyright) in any images or material taken or recorded at the Site (including by Attendees) and hereby assign any rights they may have in respect of such images, material or recordings to Green Man.

35. Attendees waive all rights (including moral rights) in any such images, material or recordings. Attendees are entitled to use any images or material taken or recorded at the Site for their personal use but not for any commercial purposes or for the endorsement of any business or product.

36. Still photographs, film, videotape or other audio-visual material recorded within the Site may not be sold, used or published commercially in any way whatsoever unless authorised by Green Man and may be confiscated by Green Man if such usage is suspected.

37. The use of photographic equipment must not inconvenience any other person in the Site.

38. Other than for private and domestic use, any persons attending Green Man shall not record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of Green Man, the Site or any match (including any results, statistics, information or other data in respect of the match, whether in whole or in part) or to assist any other person(s) conducting such activities. 39. Dangerous behaviour, fly pitching or sale of any other goods or other unauthorised trading will result in immediate expulsion from the site.

40. No unauthorised recordings of the event. All images and sound recordings remain the property of the Green Man Festival.

Covid-19:

41. Green Man reserves the right to refuse entry to, or to eject from the Site, anyone who has tested positive for COVID-19 within 10 days of the commencement of the Festival; or is otherwise required to self-isolate.

42. Green Man may be required to amend our Covid-19 guidelines before or during the Festival and Ticket holders must comply with all updates before, during and after attending the Festival.

43. The UK or Welsh Governments may amend their Covid-19 guidelines before or during the Festival and Ticket holders must comply with all updates before, during and after attending the Festival.

Limitation of Liability:

44. Green Man shall not be liable for the loss or damage of vehicles, goods or other materials belonging to attendees, guests, artists and crew attending the Site.

45. In no event shall Green Man or any of its servants agents or providers be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the Green Man Festival whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise other than:

(a) in any circumstances where there is a breach of a legal duty of care owed Green Man; or

(b) in circumstances where such loss or damage is reasonably foreseeable result of any such breach; and

(c) to the extent that any increase in any loss or damage does not arise from breach by You of any of these Terms and Conditions.

46. Notwithstanding the above, nothing in these Conditions of Entry shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability, which may not by applicable law be excluded or limited.

47. Green Man will not be responsible for any theft, damage or loss to Attendee’s vehicles, equipment and personal possessions.

48. Green Man will not be responsible if Ticket Holders catch COVID-19 at the Festival or for any illness or death of any Festival Ticket Holders caused by COVID-19.

GREEN MAN RESERVES THE RIGHT FOR ITS AUTHORISED EMPLOYEES, AGENTS, CONTRACTORS AND POLICE OFFICERS ACTING REASONABLY TO REMOVE FROM THE SITE (WITHOUT REFUND OR COMPENSATION) ANY PERSON WHO CONTRAVENES THE ABOVE ‘CONDITIONS OF ENTRY AND TERMS OF USE AND ANY PERSON WHOSE PRESENCE AND/OR BEHAVIOUR IN THE SITE COULD REASONABLY BE CONSTRUED AS DANGEROUS, A NUISANCE OR ANNOYANCE TO ANY OTHER PERSON IN THE SITE. ANY SUCH REMOVAL MAY RESULT IN FURTHER ACTION INCLUDING, BUT NOT LIMITED TO, GREEN MAN ISSUING SUCH PERSONS WITH A BAN PROHIBITING FUTURE ATTENDANCE AT THE SITE AND/OR LEGAL PROCEEDINGS BEING TAKEN.

These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase, as purchase of Tickets constitutes acceptance of these Terms and Conditions. Entry to and use of the Green Man Site is subject to the “Conditions of Entry and Site Use” which can be accessed via the Green Man Festival website.

General:

1. In these Terms and Conditions “We”, “Our” or “Us” shall refer Plantpot Limited and “You” and “Your” shall refer to such person purchasing a Ticket.

2. Please note that access to the Festival Site is subject to holding a valid ticket and subject to the Conditions of Entry and Site Use which can be found at www.greenman.net.

3. For the purposes hereof “Ticket” shall mean a ticket or voucher which entitles the purchaser to acquire a corresponding wristband at the Festival ticket office authorising entry to the Festival site (“Site”) corresponding to the Ticket purchased. You may also be required to present Your photo ID when acquiring your wristband. Wristbands are not transferable.

4. Only ticket holders holding tickets for live-in vehicles and caravans will be permitted to bring vehicles on the Site other than in designated parking areas.

5. Facilities available for disabled access can be found on our website www.greenman.net. Please ensure that our facilities are sufficient for any specific needs prior to the purchase of Tickets.

6. Removing any part of, altering or defacing the Ticket may invalidate Your Ticket. It is Your responsibility to check Your Ticket(s) as mistakes cannot always be rectified after purchase. Please check your Ticket(s) on receipt carefully and contact us immediately if there is a mistake.

7. We will not be responsible for any Ticket that is lost, stolen or destroyed. We only accept responsibility for Tickets bought from us. Any queries regarding Tickets purchased from ticket Agents must be directed to the relevant Agent from which the Ticket was purchased.

8. It is not always possible to issue duplicate ticket(s). Duplicates may be issued at our discretion.

9. Tickets must only be purchased for personal use and not be used for onward sale, advertising, promotions, contests or sweepstakes. Tickets are non-transferable between 15th and 18th August 2024. Wristbands or similar accreditation cannot be transferred.

Price and payment:

10.1 The price of the Ticket shall be the price set at the time We accept Your order. All advertised prices are inclusive of any applicable taxes and per Ticket booking fee (where applicable) but exclusive of any per transaction, collection or delivery fee.

10.2 Credit/debit card fees may be charged per ticket.

10.3 No order will be accepted until We have received full payment in cleared funds. We reserve the right to cancel any booking which We reasonably suspect to have been made fraudulently.

Changes to festival and line up:

11.1 Green Man reserves the right to make alterations to the published line up and scheduled programme of events where reasonably necessary. Any required changes shall not entitled You to any refund of reduction in Price.

11.2 We will use Our reasonable endeavours to notify You using the details You provided Us with at the time of ordering in the event that for any reason the Festival is cancelled. It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering Tickets to receive such notifications.

Refunds:

12.1 In the event that the Festival is not held or cancelled for any reason You will be entitled to claim a refund from Us in accordance with the following provisions.

12.2 The refund for Ticket(s) equals the greater of the price paid by You to Us for such Ticket, or the face value of the tickets.

12.3 Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets. We shall not be responsible for refunds of Tickets purchased through a third party.

12.4 These Terms and Conditions do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice, or the Department for Business Innovation and Skills

Liability

13.1 In no event shall Green Man or any of its servants agents or providers be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the Green Man Festival whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise other than: (a) in any circumstances where there is a breach of a legal duty of care owed Green Man; (b) in circumstances where such loss or damage is reasonably foreseeable result of any such breach; and (c) to the extent that any increase in any loss or damage does not arise from breach by You of any of these Terms and Conditions.

13.2 Personal arrangements including travel, accommodation or hospitality relating to the Festival which have been arranged by You are at your own risk. Unless otherwise stated in this clause, Green Man(s)’ liability to You in connection with the Festival (including, but not limited to, in the Festival of cancellation, shall be limited to the Ticket price paid by You including the per Ticket booking fee but excluding the per transaction collection or delivery fee.

13.3 Green Man shall not be liable for the loss or damage of vehicles, goods or other materials belonging to attendees, guests, artists and crew attending the Site.

13.4 Green Man will not be responsible if Ticket Holders catch COVID-19 at the Festival or for any illness or death of any Festival Ticket Holders caused by COVID-19.

13.5 Notwithstanding the above, nothing in these Conditions of Entry shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability, which may not by applicable law be excluded or limited.

Invalid tickets

15.1 Any Ticket obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void. The holder shall not be entitled to receive a wrist band entitling entry to the Site.

15.2 Any person seeking to use such a void Ticket in order to gain or provide entry to a Festival may be considered to be a trespasser and may be liable to be ejected and liable to legal action. Void Ticket(s) are non-refundable.

15.3 Tickets may be subject to certain restrictions on entry or use and specifically with or without vehicles. Any such restriction shall be displayed on Our website and should be confirmed by You before You book Ticket(s).

15.4 It is Your responsibility to ensure that You read all notifications displayed on Our website. We reserve the right to cancel Ticket(s) purchased in excess of the maximum number, without prior notice unless the purchase of Ticket(s) in excess was due to Our error, in which case We will notify You prior to cancelling Your Ticket(s).

15.4 No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour.


Health and safety

16.1 Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Festival. If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Festival, prior notice should be provided when ordering Tickets. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.

16.2 Smoking is not permitted unless within a designated smoking Area (if any).

Dispute resolution

17.1 Any complaints about the Festival should be made promptly to Green Man.

17.2 If any dispute arises Green man will attempt to resolve it. Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days, the parties may attempt to settle it by mediation. To, initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation.

Assignment:

18. We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.

Third parties:

19. Any person who is not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 (the ‘Act’).

Events beyond our reasonable control (force majeure)

20. For the purposes of these Terms and Conditions, ‘Force Majeure’ means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, disease, fire, explosion, flood, theft of essential equipment, malicious damage, pandemic, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

21. Any competition or fundraiser entered in relation to winning Green Man tickets is at the discreation of Green Man. The prize tickets cannot be exchanged, refunded, rolled over to another year and have no monetary value. Green Man reserves the right to cancel these tickets at its discretion.

Whole agreement:

22. These Terms and Conditions constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not) other than as expressly communicated by Us to You before You have completed Your purchase or set out in these Terms and Conditions.
